Manteca Police posts video of fatal shooting

This is a screen shot from a dashboard camera in a Manteca Police unit that was rammed 8 minutes after arriving on scene April 30 at the fatal officer involved shooting at the Manteca In and Out Burger. This frame was captured after the first arriving officer fired several shots into the vehicle after the police unit was rammed twice. The fatal confrontation occurred 15 minutes later.

A video regarding the fatal shooting involving five officers at the In-N-Out Burger on East Yosemite Avenue on April 30 was posted Friday by the Manteca Police Department on its social media platforms.

The posting comes after the California Department of Justice concluded the driver of the white van used it as a deadly weapon. As such, the investigation is now in the domain of the San Joaquin County District Attorney’s Office.

Police Chief Stephen Schluer narrates the 18 minute and 59 second video you can find on the department’s Facebook account.

It employs bodycam, dashcam, drone and other video footage.

Schluer advises parts of the video are graphic and, therefore, may not be appropriate to view.

The incident ended with Charles Craig Mcgonegal, 69, of Lathrop being fatally shot.

The video also includes the 9-1-1 call.

Officers were called to the In-N-Out Burger by employees after they noticed the driver in a white van was agitated and had rammed cars in the same lane of an order pickup queue.

The employees refused to serve the driver.

At some point, Mcgonegal was able to get his van out of the line.

He drove around back toward the order line striking — and then dragging — a drive-thru sign.

The first officer was on scene trying to deescalate the situation when, after 8 minutes, Mcgonegal suddenly rammed his patrol unit twice.

That was when the officer fired off several shots as it appeared the driver was getting ready to ram the police vehicle again.

Right after the shooting, the officer ordered the driver repeatedly “to get out of the car.”

He then said “I don’t want to hurt you twice” before adding “I want this to end peacefully. I don’t want to hurt you. I want to provide you medical help.”

At that point, the officer did not know whether Mcgonegal had been struck by one of the shots.

The driver then started smoking a cigarette with his left hand but officers couldn’t see his right hand.

Other officers responded, locked down the parking lot, and worked to try and de-escalate the situation.

An officer, at one point, gets close enough that his bodycam is filled with the image of the drive smoking his cigarette.

Then after 15 minutes, Mcgonegal backs up his van a significant distance, stops, then puts it in drive, hits the gas and rams another police unit hard enough to push it back several feet.

He then backs, and rams the vehicle again at which point five officers opened fire.
